The US Supreme Court has ordered that Troy Davis should be given a new hearing so that evidence not originally heard at his trial proves he is innocent.
He was originally convicted of killing a police officer in Georgia but key witnesses have recanted their testimony, some claiming they were put under pressure by cops. In all, seven of the nine witnesses have retracted the testimony given at the original trial.
One of the two remaining witnesses who are sticking to their story is implicated in the murder. Lawyers say there are several new witnesses who have identified a different individual in the killing of police officer Mark MacPail in 1989.
The State of Georgia fought to the last to have the the appeal rejected. These people really want to kill this guy innocent or not. Two Conservative justices dissented they were Justices Antonin Scalia and Clarence Thomas.
Justice John Paul Stevens, supported by Justices Ruth Bader Ginsburg and Stephen Breyer said the dissenting justices were wrong. “The substantial risk of putting an innocent man to death clearly provides an adequate justification for holding an evidentiary hearing,” wrote Justice Stevens.
